Introduction

Welcome to the DEXDEV Platform. We fully understand the importance of user information to you. Protecting your user information and privacy security is our foremost responsibility. We strictly comply with applicable laws and regulations and implement necessary security safeguards to protect your information security. For this purpose, Dexmal (Chongqing) Technology Co., Ltd. ("we", "us", "our" or "Dexmal") has formulated this DEXDEV Platform Privacy Policy (this "Policy") to clearly explain to you how we collect, use, share, store and protect your user information when you use our products and/or services, and what rights you have to manage such information. We hope this Policy will help you make appropriate choices on a fully informed basis.

Please read this Policy in full and ensure that you fully understand all of its contents before using our products or services. Please pay particular attention to the provisions highlighted in bold, and use our products or services only after you have confirmed that you have no questions. In addition to this Policy, for specific functions or scenarios, we may also inform you of the specific purposes, scope and uses of information collection in such scenarios by means of pop-up prompts, page descriptions, feature update announcements and other methods. Such notices form an integral part of this Policy and have the same legal effect. For professional terms used in this Policy, we will endeavor to explain them in plain and understandable language for your convenience. If you have any questions, comments or suggestions regarding this Policy, you are welcome to contact us through the contact details set forth herein.

Your agreement to this Privacy Policy indicates that you understand the functions provided by the web pages, as well as the necessary personal information required for the operation of such functions, and that you grant the corresponding authorization for collection and use. However, this does not mean that you have separately consented to enabling additional functions or to the processing of non-essential personal information. For the enabling of additional functions, the processing of non-essential personal information, and the processing of sensitive personal information, we will seek your separate consent according to your actual use.

I. Scope of Application

This Policy applies to the DEXDEV Platform website and all products and/or services provided to you through new forms that may emerge with technological development. If any product or service provided to you by us or our affiliates has a separate privacy policy or similar legal document, such separate document shall prevail.

II. How We Collect and Use Your User Information

When you use our products and/or services, the personal information that we need or may need to collect and use includes the following two categories:

  1. Necessary information that you must authorize us to collect and use in order for us to provide the basic functions of our products and/or services to you and to fulfill obligations prescribed by laws and regulations. If you refuse to provide such information, you will be unable to use our products and/or services normally.
  2. Information that you may separately choose to consent or not consent to our collection and use in order for us to provide additional functions of our products and/or services to you. If you refuse to provide such information, you may be unable to use the relevant additional functions normally or the intended functional effects may not be achieved, but this will not affect your use of our basic functions.

We hereby specifically remind you that we are committed to developing diverse products and/or services to meet your needs. Since we provide a wide range of products and/or services, and different users may choose to use different specific products and/or services, the basic functions or additional functions, as well as the types and scope of personal information collected and used accordingly, may vary. Please refer to the specific product and/or service function actually provided.

The specific functional scenarios we provide to you include the following:

(I) Registration and Login

You may choose to create a new account. When you create an account, you must provide us with your mobile phone number and set and confirm your nickname and login password. If you refuse to provide the above information, you will be unable to register an account. The mobile phone number you submit will be used to receive verification codes when you register, log in, bind your account or retrieve your password, and will also serve as one of the contact methods designated between you and us for receiving relevant business notices, such as notices on new features and service changes.

(II) Participation in Projects, Community Activities and Product Experiences

Dexmal is committed to exploring and promoting technology. Through the DEXDEV Platform, we may organize various academic exchange projects, community activities and geek competitions, and provide laboratory product demonstration ("Demo") experiences.

1. Activity Registration and Participation

In order to manage and process your project applications and competition registrations, facilitate activity procedures and provide relevant services, we may collect and use personal information that you voluntarily provide on the activity page or that is generated during the project process, such as your name, contact information, team information, project proposal and code submission records. The specific information fields to be collected will be clearly and expressly disclosed to you on the registration page of each activity or competition according to the actual needs of such activity or competition, and will be collected only after we have obtained your separate authorization and consent. If you do not register for or participate in such activities, we will not collect any related personal information from you.

2. Laboratory Experience/Demo

When you use the laboratory experience or product demonstration functions provided by us, in order to provide an immersive interactive experience, we may, according to the actual needs of the specific Demo and after obtaining your separate consent, access necessary sensors or functions of your device, such as the camera or microphone. Unless otherwise stated on the experience page and consented to by you, the data generated from such access will be processed only on your local device and will not be uploaded to our servers.

(III) Operational Analytics

We may use log data, including your browser information and type, the date and time of your requests, and how you interact with our website; usage information, including your location, the date and time of access to the services, server-side date and time of access, type of computer or mobile device and network information; device information; and online analytics products such as Cookies, to help us analyze how users use our products and/or services and to enhance your product and/or service experience. You may manage or delete Cookies through your browser settings, but this may affect the normal use of certain functions.

We undertake that we will not use Cookies for any purpose other than those described in this Privacy Policy. We use Cookies mainly to ensure the secure and efficient operation of the product and/or service experience, to allow us to confirm the security status of your account, investigate crashes, latency and other abnormal conditions, and help you avoid repeatedly filling in forms or entering search content.

(IV) Providing Security Safeguards for You

In order to improve the security of our products and/or services, protect the personal safety, property safety and account security of you, other users or the public, better prevent phishing websites, fraud, network vulnerabilities, computer viruses, cyberattacks, network intrusions, malicious programs and other security risks, and more accurately identify violations of laws and regulations or relevant agreements and rules, we and our affiliates will collect your device information and log information, and may use or integrate your device information and log information to comprehensively assess your account and usage risks, conduct identity verification, detect and prevent security incidents, and take necessary recording, auditing, analysis and handling measures in accordance with law.

(V) Circumstances Where Your Authorization and Consent Are Exempted by Law

Please understand that, under the following circumstances, according to applicable laws, we do not need to obtain your authorization and consent before transferring or publicly disclosing your personal information:

  1. Where it is related to national security or national defense security;
  2. Where it is related to public security, public health or major public interests;
  3. Where it is related to criminal investigation, prosecution, trial or enforcement of judgments;
  4. Where it is necessary to respond to a public health emergency, or necessary in an emergency to protect the life, health or property safety of you or other natural persons;
  5. Where the personal information collected has been disclosed to the public by you on your own initiative;
  6. Where your personal information is collected from information lawfully and publicly disclosed, such as lawful news reports or government information disclosure;
  7. Where it is necessary for the conclusion or performance of a contract at your request;
  8. Where it is necessary to maintain the secure and stable operation of the products and/or services provided, such as detecting and handling product and/or service failures;
  9. Where it is necessary for lawful news reporting;
  10. Where it is necessary for statistical or academic research conducted by academic research institutions in the public interest, provided that when academic research or descriptive results are externally provided, the personal information contained in such results is de-identified;
  11. Where it is related to our fulfillment of obligations prescribed by laws and regulations;
  12. Other circumstances prescribed by laws and regulations.

Please understand that the functions and services we provide to you are continuously updated and developed. If a function or service is not included in the above description but collects your information, we will separately explain the content, scope and purpose of the information collection to you by means of page prompts, interactive procedures, website announcements, separate agreements and other methods, so as to obtain your consent.

III. How We Share, Transfer and Publicly Disclose Your User Information

(I) Sharing

We will not share your personal information with any company, organization or individual outside Dexmal, except in the following circumstances:

  1. Where your express consent or authorization has been obtained in advance;
  2. Where you request it on your own initiative;
  3. Where it is required by laws and regulations or by mandatory administrative or judicial requirements;
  4. Where it is consistent with relevant agreements signed with you, including electronic agreements signed online and corresponding platform rules, or other legal documents;
  5. We may share your personal information with our affiliates. However, we will only share necessary personal information and such sharing will be bound by the purposes stated in this Policy. If our affiliates intend to change the purpose of processing personal information, they will seek your authorization and consent again;
  6. In order to achieve the purposes stated in this Policy, some of our services will be provided by authorized partners. We may share certain personal information about you with our partners in order to provide better customer service and user experience. We will share your personal information only for lawful, legitimate, necessary, specific and explicit purposes, and only the personal information necessary to provide the services will be shared. Our partners have no right to use the shared personal information for any other purpose. Currently, Dexmal's authorized partners include our suppliers, service providers and other partners. We provide information to suppliers, service providers and other partners who support our business worldwide, including by providing technical infrastructure services and transaction and communication services, such as payment, logistics, SMS and email services. For companies, organizations and individuals with whom we share personal information, we will enter into agreements with them requiring them to process personal information in accordance with our instructions, this Policy and other relevant arrangements, and to adopt necessary security protection measures;
  7. You may actively disclose or share your personal information or other information with third parties, including unspecified recipients. Please note that any information you share or disclose may be read, collected and used by any third party. Please carefully consider publishing or disseminating content containing your personal information through the products. Dexmal shall have no connection with, and shall not bear legal liability for, any information leakage, use or related circumstances arising from your disclosure or sharing.

(II) Transfer

In principle, we will not transfer your user information to other organizations or individuals. However, in the event of a merger, acquisition or bankruptcy liquidation involving Dexmal and another legal entity, or other circumstances involving merger, acquisition or bankruptcy liquidation, if the transfer of user information is involved, we will require the new company or organization holding your user information to continue to be bound by this Policy. Otherwise, we will require such company, organization or individual to seek your authorization and consent again. In the event of bankruptcy where there is no successor, we will delete the data in accordance with law.

(III) Public Disclosure

We will publicly disclose your user information only under the following circumstances:

  1. With your full consent or based on your active choice, we may publicly disclose your user information; or
  2. In order to protect Dexmal, its platform, its affiliates, its users or the public from harm to personal or property safety, we may disclose your user information based on laws and regulations or mandatory administrative or judicial requirements.

(IV) Exceptions to Prior Authorization and Consent for External Provision of User Information

Under the following circumstances, external provision of user information does not require your prior authorization and consent:

  1. Where it is related to national security or national defense security;
  2. Where it is related to public security, public health or major public interests;
  3. Where it is related to criminal investigation, prosecution, trial or enforcement of judgments;
  4. Where it is necessary to protect major lawful rights and interests such as the life or property of you or other individuals, but it is difficult to obtain your consent;
  5. Where the personal information collected has been disclosed to the public by you on your own initiative;
  6. Where your personal information is collected from information lawfully and publicly disclosed, such as lawful news reports or government information disclosure;
  7. Where it is necessary for the conclusion or performance of a contract at your request;
  8. Where it is necessary to maintain the secure and stable operation of the products and/or services provided, such as detecting and handling product and/or service failures;
  9. Where it is necessary for lawful news reporting;
  10. Where it is necessary for statistical or academic research conducted by academic research institutions in the public interest, provided that when academic research or descriptive results are externally provided, the personal information contained in such results is de-identified;
  11. Where it is related to our fulfillment of obligations prescribed by laws and regulations;
  12. Other circumstances prescribed by laws and regulations.

Please note that, according to current laws and regulatory requirements, where personal information is shared or transferred after anonymization and the data recipient cannot restore or re-identify the personal information subject, separate notice to you and your consent are not required.

IV. How You Manage Your User Information

You may access and manage your information in the following ways. We will respond to your requests in accordance with applicable laws and regulations:

(I) Access, Correction and Supplementation

You have the right to access, correct and supplement your information on the relevant page after logging in to your personal center.

(II) Copying

You may copy the information you need on the relevant page after logging in to your personal center.

(III) Deletion

After logging in to your personal center, you may delete specific information published by you, such as profile information and historical records. If you wish to delete all of your personal information, you may do so by applying to cancel your account.

You may also request that we delete specific or all personal information under the following circumstances:

  1. If our processing of personal information violates laws or regulations;
  2. If we collect or use your personal information without obtaining your express consent;
  3. If our processing of personal information seriously violates our agreement with you;
  4. If the purpose of processing has been achieved, cannot be achieved, or is no longer necessary for achieving the processing purpose;
  5. If we cease to provide products and/or services, or the retention period has expired.

If we decide to respond to your deletion request, we will also, to the extent possible, notify the entities that have obtained your personal information from us and require them to delete it in a timely manner, unless otherwise provided by laws and regulations or such entities have independently obtained your authorization.

After you delete relevant information or we assist you in deleting relevant information, due to applicable legal and security technology limitations, we may be unable to immediately delete the corresponding information from backup systems. We will securely store your personal information and restrict any further processing of it until the backup can be cleared or anonymized.

(IV) Changing the Scope of Authorization

You may change or withdraw the scope of your authorization for us to process your personal information by contacting us.

(V) Account Cancellation

You may apply to cancel your account through account security after logging in to your personal center. After you voluntarily cancel your account, we will stop providing services to you and will delete or anonymize your personal information, unless otherwise provided by laws and regulations.

(VI) Responding to Your Requests

You, or where applicable your guardian, close relatives or other authorized subjects, may submit the above requests to us and assert your relevant personal information rights under the laws of the People's Republic of China and other applicable laws by contacting us at developer@dexmal.com. We will respond within fifteen (15) business days.

To protect your account security and the security of your personal information, when you submit the above requests to us, we may first verify your identity, such as by adding account verification, requiring you to provide a written request or using other reasonable methods, before processing your request.

In principle, we do not charge fees for your reasonable requests. However, for requests that are repeated multiple times or exceed reasonable limits, we may charge a certain fee at our discretion. We may refuse requests that are not directly related to your identity, are repeated without reasonable grounds, require excessive technical means, such as developing a new system or fundamentally changing existing practices, pose risks to the lawful rights and interests of others, or are impracticable.

V. How We Protect and Store Your User Information

  1. Retention Period. In general, we retain your personal information only for the shortest period necessary to achieve the purposes authorized by you, unless otherwise provided by laws and regulations or separately authorized and consented to by you. After the above retention period for personal information expires, we will delete or anonymize your personal information.
  2. Storage Location. Personal information collected and generated by us within the territory of the People's Republic of China will be stored within the territory of the People's Republic of China.
  3. Dexmal attaches great importance to your information security. We endeavor to adopt various reasonable physical, electronic and administrative security measures to protect your user information and prevent unauthorized access, public disclosure, use, modification, damage or loss of user information. For example, we use encryption technologies to enhance the security of user information; we use trusted protection mechanisms to prevent malicious attacks against user information; we deploy access control mechanisms and endeavor to ensure that only authorized personnel may access user information; and we conduct security and privacy protection training courses to strengthen employees' awareness of the importance of protecting user information.
  4. We will take reasonable and practicable measures and make our best efforts to avoid collecting irrelevant user information. We will retain your user information only for the period necessary to achieve the purposes described in this Policy, unless permitted by law. After the above retention period expires, we will delete or anonymize your personal information.
  5. We classify and grade personal information according to its type and sensitivity, and adopt corresponding technical protection measures based on the classification and grading results, including but not limited to access control, de-identification, encrypted storage and isolated storage. We also adopt technical measures such as desensitized display and encrypted transmission during information display and transmission to ensure the security of your personal information.
  6. Although we have adopted reasonable and effective security measures in accordance with the requirements of relevant laws and regulations, due to technical limitations and possible malicious means, we cannot guarantee absolute information security. Please understand that the systems and communication networks we provide may encounter problems due to factors beyond our control. Therefore, we strongly recommend that you take proactive measures to protect the security of your personal information, such as using complex passwords, changing passwords regularly, and not disclosing your account password or relevant personal information to others.
  7. In the unfortunate event of a user information security incident, such as leakage or loss, we will, in accordance with the requirements of laws and regulations, promptly inform you of the basic circumstances and possible impact of the security incident, the measures we have taken or will take, suggestions for you to independently prevent and reduce risks, remedial measures for you, and other relevant matters. We will promptly inform you of the incident by email, letter, telephone, push notification or other means. Where it is difficult to notify user information subjects individually, we will issue an announcement in a reasonable and effective manner. At the same time, we will report the handling of the user information security incident to the regulatory authorities as required.
  8. If Dexmal's products and services cease operation, we will take reasonable measures to protect the security of your user information, including promptly stopping further collection of user information; notifying users of the cessation of operation by individual delivery or public announcement; and deleting or anonymizing the personal information we hold.

VI. Protection of Minors

  1. For this product/service, we presume that you have the corresponding civil capacity. Please exercise caution when uploading text and images relating to minors. If you are a minor, we require that your parents or other guardians carefully read this Policy and that you use our products and/or services or provide information to us only with the consent of your parents or other guardians.
  2. If you are a child under the age of fourteen (14), before using the services, you and your guardian should carefully read this Policy and ensure that you use our products and/or services under the guidance of your guardian only after your guardian has agreed to this Policy, so as to ensure your safety when using our products and/or services.
  3. If you are the parent or other guardian of a child, please pay attention to whether the child uses our products and/or services after obtaining your authorization and consent. If you have any questions about the child's personal information, please contact us.

VII. Updates to this Policy

In order to provide you with a better product and/or service experience, we continuously strive to improve our technology. We may update our Privacy Policy. We will publish any amendments to this Policy on the web page so that you can keep informed of the latest version of this Privacy Policy in a timely manner. However, without your express consent, we will not restrict the rights you enjoy under this Policy.

For material changes, we will also provide more prominent notice, including by website announcement and even pop-up prompts, to inform you, and will obtain your consent in accordance with the relevant requirements of laws and regulations.

VIII. How to Contact Us

We have appointed a dedicated person in charge of personal information protection. If you have any questions, comments or suggestions regarding this Policy, you may contact the person in charge of personal information protection at developer@dexmal.com. We will respond to your request within fifteen (15) business days. Please note that we may not respond to questions unrelated to this Policy or your personal information rights.

Appendix: Relevant Definitions

  • Personal Information: Various information recorded electronically or by other means that relates to an identified or identifiable natural person, excluding information that has been anonymized.
  • Sensitive Personal Information: Personal information that, once leaked or illegally used, may easily result in harm to the dignity of a natural person or harm to personal or property safety, including information such as biometric identification, religious belief, specific identity, medical and health information, financial accounts and whereabouts, as well as personal information of minors under the age of fourteen.
  • Child: A minor under the age of fourteen.
  • Log Information: Information including user ID, generated content, IP address, browser type and version, telecommunications operator, access date and time, and your interactions with the website, such as page views and clicks.
  • De-identification: The process by which personal information is processed so that a specific natural person cannot be identified without the aid of additional information.
  • Anonymization: The process by which personal information is processed so that a specific natural person cannot be identified and the information cannot be restored.
  • Cookie: Cookies and similar device information identification technologies are commonly used on the internet. When you use products and/or services, we may use relevant technologies to send one or more Cookies or anonymous identifiers to your device in order to collect, identify and store information about your access to and use of the product.
